Anak ni Napoles, nagpiyansa sa kasong tax evasion

MANILA, Philippines – Nagpiyansa na nitong Lunes sa Court of Tax Appeals ang anak ni Janet Lim Napoles na Jeanne Napoles kaugnay sa kinakaharap nitong tax evasion case ayon sa abogado nitong si Atty. Stephen David.

Ito ay upang hindi maaresto sakaling maglabas ng warrant of arrest ang korte laban sa kanya.

P50,000 ang piyansa ni Napoles sa 1st Division para sa isang count of tax evasion.

Sinubukan din ni Napoles na maglagak ng piyansa sa 3rd Division na siyang humahawak ng isa pang count ng tax evasion ngunit hindi pa ito tinatanggap ng korte.

Ito ay sa dahilang may nakabinbin pang motion for judicial determination of probable cause ang kampo ni Napoles sa dalawang dibisyon at ipinasya ng 3rd Division na desisyunan muna ito.

September 2014 nang aprubahan ng Department of Justice (DOJ) ang pagsasampa ng kaso laban sa batang Napoles matapos na makalikom ng sapat na ebidensya ang Bureau of Internal Revenu (BIR) sa hindi nito pagbabayad ng tamang buwis na nagkakahalaga ng P17.88 million.

Kabilang aniya dito ay real properties tulad ng isang residential condominium sa California at ang dalawang farm sa Pangasinan.

Hinamon naman ng abogado ni Napoles na si Atty. Stephen David ang DOJ na ilabas ang naging basehan nito sa tax evasion case na isinampa laban kay Jean Napoles.

Anila, wala namang income si Jeanne at ipinamana lamang ang mga ari-arian at yaman na nasa kanyang pangalan.

“Imposible namang magkaroon ng income si Jeanne kasi unang-una, nag-aaral pa siya sa US. Wala naman working visa doon. 23 years old lang siya. papaano mo nasabing nagtrabaho siya kumita para makapagpundar ng ganito kalaking properties,” pahayag pa ni David.

Dagdag pa nila, nagaapply ng U.S. citizenship si Jeanne kaya’t sapat lamang na magpakita ito ng ari-arian at bank accounts na naglalaman ng malaking halaga ng pera.

Naging kontroberysal si Jeanne Napoles matapos kumalat sa social media ang isang video nagpapakita ng marangyang pamumunay nito sa Amerika.

Samantala, ipinagpatuloy ng 3rd Division ng Sandiganbayan ang bail hearing ni dating APEC Partylist Rep. Edgar Valdez sa kasong plunder kaugnay ng PDAF scam.

Humarap bilang testigo si Atty. Raymond Joel Balbuena, ang field investigator mula sa Office of the Ombudsman na siyang nagsagawa ng imbestigasyon sa umano’y partisipasyon ni Valdez sa scam.

Ipinaliwanag nito na pitong saro lamang mula 2007 hanggang 2009 na nagkakahalaga ng 82.6 million pesos ang naisama lang nila sa imbestigasyon.

Kinumpiram din nito ang unang pahayag ng kampo ng dating kongresista na naaayon sa General Appropriations Act (GAA) ang mga proyektong inendorso ni Valdez.

JBC extends application period for CA, CTA, Sandiganbayan vacancies

MANILA, Philippines – The Judicial and Bar Council on Thursday announced it has extended the application period for several vacant positions in the Court of Appeals (CA), and other courts.

In an advisory, the JBC said it moved the deadline from August 25 to September 25 following requests for extension of the deadline of submission of documents owing to the difficulty in securing documents in view of the imposition of modified enhanced community quarantine in Metro Manila and nearby provinces.

Metro Manila and the provinces of Bulacan, Rizal, Laguna, and Cavite were placed under MECQ from August 4 to 18. It has now shifted to general community quarantine status.

The JBC said there are job openings in the CA, Sandiganbayan, Court of Tax Appeals (CTA) as well as in the Legal Education Board.

CA vacancies are for the positions left by Justices Rodil Zalameda, Edgardo Delos Santos, Mario Lopez, and Samuel Gaerlan who were appointed to the Supreme Court; Justices Luisa Padilla and Jane Aurora Lantion who compulsorily retired in January 2020.

The opening in Sandiganbayan is for the position left by the late Justice Reynaldo Cruz, while the CTA vacancies are for the positions formerly held by retired Justices Cielito Mindaro-Grulla and Esperanza Fabon-Victorino.

The JBC also said applications are also open for several positions in the Legal Education Board.

The council reminded applicants to access the online application scheduler in its website on or before August 25 to register and selected the date they will submit their documents.

Applicants must also submit the complete and accurate digitized versions of their documents through electronic mail on their selected date and time of appointment in the scheduler.

The submission of hard copies of documentary requirements, however, is suspended until further notice, the JBC said.

Sandiganbayan allows Estrada, Napoles to seek plunder case dismissal

The Sandiganbayan has allowed senatorial candidate Jinggoy Estrada and businesswoman Janet Lim Napoles to file for the dismissal of the plunder charge against them.

The 5th division of the Sandiganbayan has given both parties 10 days to file their demurrer of evidence. The prosecution will also be given 10 days to respond.

The resolution states: “After a meticulous examination of the totality of evidence presented by the prosecution, both testimonial and documentary, the Court resolves to grant the present motion of the accused, to sufficiently provide him an opportunity to challenge the sufficiency of the prosecution’s evidence establishing material elements o the offense charged to support a judgment of guilt.”

Estrada and Napoles are facing plunder and graft charges following their involvement in the ‘pork barrel scam’. Estrada is accused of amassing P180 million kickback from the Priority Development Assistance Fund of bogus non-government organizations which is reportedly linked to Napoles.

Janet Napoles to serve a lifetime in jail over PDAF scam

QUEZON CITY, Philippines – The Sandiganbayan has sentenced ‘pork barrel’ scam mastermind Janet Lim-Napoles and Richard Cambe a lifetime in jail as the anti-graft court on Friday (December 7) acquitted Cambe’s former boss, former senator Ramon ‘Bong’ Revilla Jr.

Napoles and Cambe were sentenced to ‘reclusion perpetua’ or 40 years imprisonment.

Based on the decision of the Sandiganbayan Special Fifth Division, the prosecution failed to prove that Revilla was guilty of amassing P224.5M from his Priority Development Assistance Fund (PDAF) to support Napoles’ fake foundations.

The court also ruled that it was Cambe who was guilty of misusing the funds.

The Sandiganbayan also ordered Napoles, Cambe and Revilla to return P124 million in line with the case.

With the conviction, Napoles will remain inside the Correctional Institution for Women in Mandaluyong while Cambe, who was previously detained at the Philippine National Police (PNP) Custodial Center, will be transferred to the New Bilibid Prison.

On June 2014, the Office of the Ombudsman filed plunder cases before the Sandiganbayan against Revilla and his colleagues, former senators Juan Ponce Enrile and Jinggoy Estrada. Napoles and Cambe were among the co-accused.

Enrile, then 92-years-old, was allowed bail due to old age, while the court said evidence failed to establish that Estrada was the main plunderer in the case.

The case is dubbed as the biggest corruption case decided by the Sandiganbayan to date. – Marje Pelayo | UNTV News & Rescue
